These Terms of Use ("Terms") are an agreement between you and YOTTADESIGN, LLC, which operates Paycheck Paradox ("we", "us", "our"). They cover paycheckparadox.com, the Smart Money Hub web app, the Paycheck Paradox podcast, and the Paycheck Paradox apps for iPhone and Android (together, the "Services"). By using the Services you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
1. Not investment advice
Paycheck Paradox publishes education and commentary about personal finance and investing. Nothing in the Services is investment, financial, tax, legal or accounting advice, or a recommendation to buy, sell or hold any security or financial product. We are not registered investment advisers, broker-dealers or financial planners, and we don't know your situation. Calculators show illustrations based on the assumptions you choose; actual results will differ. Markets involve risk, including the loss of your money. Past performance, including our own published performance and trades, does not predict future results. Before making financial decisions, do your own research and consider talking to a licensed professional.
Our own positions. The people behind Paycheck Paradox invest their own money, may hold positions in securities we discuss, and may buy or sell them at any time, including before or after we publish. Our published performance is self-reported and unaudited, covers only the accounts we choose to share, and may not reflect taxes or all fees. We are not paid by the companies we write about.
2. AI-produced content
Some content is produced with AI tools, including podcast episodes read by AI voices and AI summaries of market news (Moves That Matter). We label this content. AI content can contain mistakes or omissions; check the original sources before relying on it.
3. Your account
You must be at least 18 years old to create an account. Give us accurate information, keep your password secure and tell us if you think your account has been used without permission. You're responsible for what happens under your account. If you invite family members to share your data, they can see and change your saved calculations and card tracker, and you can remove them at any time.
4. Paycheck Paradox Pro (subscriptions)
Free trial. New accounts may receive a free trial of Pro, with no payment method required, for the period shown when you sign up. The app stores may also offer an introductory free trial when you subscribe; if they do, the subscription starts charging automatically when that trial ends unless you cancel at least 24 hours before it ends.
Auto-renewal. Pro is a subscription that renews automatically at the end of each period (monthly or yearly) at the then-current price until you cancel. The price and billing period are shown before you subscribe. Prices can differ between our website and the app stores and may vary by country; the price you'll pay is the one shown at checkout.
Where you subscribe determines how you pay and cancel.
- On our website (payments processed by Square): cancel any time from the Pro page in your account. You keep Pro until the end of the period you've paid for.
- In the iPhone app: billed to your Apple Account. Manage or cancel in your device Settings → your name → Subscriptions, at least 24 hours before renewal.
- In the Android app: billed through Google Play. Manage or cancel in the Google Play app → Payments & subscriptions → Subscriptions.
Deleting your account or the app does not cancel a subscription bought through Apple or Google; cancel it with the store. If you delete your account while a website subscription is active, we cancel that subscription for you.
Refunds. App store purchases are refunded under Apple's or Google's policies; request them from the store. For website purchases, payments are non-refundable except where required by law, but if something went wrong, email us and we'll look at it.
Price changes. We may change Pro prices. We'll tell you in advance, and the new price applies from your next renewal; you can cancel before then.
What's included. Pro features are described on our Pro page. We may add, change or remove features over time. Features labeled "Coming soon" are not yet included.
Family Sharing. If you subscribe in the iPhone app, you can share Pro with your Apple Family Sharing group. Family data sharing in Paycheck Paradox shares your saved calculations and card tracker with people you invite; it does not share Pro.
5. Acceptable use
Don't: break the law using the Services; access accounts or data that aren't yours; probe, scan, scrape, copy or harvest the Services or their data by automated means; interfere with or overload the Services; reverse engineer the apps except where the law allows; resell, sublicense or redistribute the Services or Pro content (including our trades and Moves That Matter) without our written permission; or upload anything unlawful, harmful or that infringes others' rights.
6. Our content and your content
The Services, including articles, episodes, calculators, designs and software, belong to us or our licensors and are protected by law. We give you a personal, non-transferable, revocable license to use them for your own non-commercial purposes under these Terms. What you enter (such as saved calculations and card tracker data) remains yours; you give us permission to store and process it only to provide the Services to you and the people you choose to share it with.
7. Third-party names and offers
Card, bank, issuer and company names, including American Express and Chase, are trademarks of their owners and are used only to identify them. Paycheck Paradox is not affiliated with, sponsored by or endorsed by any card issuer, bank or company we mention. Card offers we list are examples we've seen; offers are targeted, change often and may not be available to you. Always check terms with the issuer. Links to other sites are provided for convenience; we're not responsible for their content.
8. Changes and ending the Services
We may change, suspend or discontinue any part of the Services. We may suspend or close accounts that break these Terms or put the Services or other users at risk. You can stop using the Services and delete your account at any time.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We don't guarantee that the Services, calculations, data (including market data, performance and offers) or AI content are accurate, complete, current or uninterrupted.
10. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, INVESTMENT LOSSES, LOST DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR RELIANCE ON ANY CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Some places don't allow these limits, so they may not fully apply to you.
11. Indemnity
You agree to defend and hold us harmless from claims arising from your misuse of the Services or your breach of these Terms.
12. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Virginia, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court where it qualifies. If you're a consumer in a country whose laws give you rights that can't be waived, nothing here takes those away.
13. Apple and Google
If you use an app downloaded from the Apple App Store or Google Play, these Terms are between you and us, not Apple or Google, and we, not they, are responsible for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms for apps obtained from the App Store and may enforce them. Your use of the app must also comply with the store's terms (for Apple, the Usage Rules in the Apple Media Services Terms and Conditions). Apple has no obligation to provide maintenance or support for the app; for any warranty that applies by law, you may notify Apple for a refund of the purchase price, if any, and Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance and consumer protection claims, or third-party intellectual property claims.
14. General
These Terms and our Privacy Policy are the whole agreement between us about the Services. If part of these Terms can't be enforced, the rest stays in effect. Our not enforcing a right isn't a waiver. You can't transfer these Terms; we may transfer them in connection with a business transfer. We'll post changes here and update the effective date; if a change is significant we'll give notice in the Services or by email. Using the Services after changes take effect means you accept them.
